Vysual Labs LLC ("Vysual," "Company," "we," "us," or "our") respects your privacy and is committed to protecting personal information collected through the Vysual platform and related services (the "Platform").
This Privacy Policy explains what information we collect, how we use it, with whom we share it, how we protect it, and what rights you have regarding your information. By using the Platform, you agree to the collection and use of information as described in this Privacy Policy.
This Privacy Policy is incorporated into and subject to the Vysual Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Information We Collect
Account Information
When you create an account, we collect:
- name and job title
- business email address
- company name and size
- account credentials (password stored in hashed form only)
- billing and payment information (processed by our payment processor; we do not store full card numbers)
Workspace and Asset Data
When using the Platform, users upload digital assets into Workspaces. This may include:
- video files, images, audio recordings, and documents
- transcripts and captions generated from uploaded media
- metadata, tags, and asset descriptions
- file names, sizes, formats, and upload timestamps
Vysual processes uploaded assets to provide Platform functionality (thumbnails, transcripts, search indexing, AI tagging). Vysual does not use the content of uploaded assets to train AI or machine learning models without your separate written consent.
Collaboration and Workspace Activity Data
Workspaces may include multiple users and collaborators. We collect information related to:
- user permissions and role assignments
- asset sharing and access activity
- collaboration events such as uploads, edits, downloads, and deletions
Activity logs are retained for ninety (90) days and are available to Workspace administrators upon written request.
Usage and Technical Data
We automatically collect technical information when you use the Platform, including:
- browser type, version, and operating system
- device type and identifiers
- IP address and approximate geographic location
- pages and features accessed, and actions performed
- session duration and system performance data
This information is used to operate, secure, and improve the Platform.
Communications Data
If you contact us for support or respond to our communications, we retain those records to assist with your requests and improve our service.
2. How We Use Information
We use collected information to:
- provide, operate, and maintain the Platform
- create and manage user accounts and Workspaces
- process subscription payments and manage billing
- store, organize, and process digital assets
- generate metadata, transcripts, and search indexes from uploaded assets
- enable Workspace collaboration and asset sharing
- provide customer support and respond to inquiries
- send service-related communications including notices, updates, and security alerts
- analyze usage trends to improve Platform functionality and reliability
- detect, investigate, and prevent fraud, abuse, and security incidents
- comply with legal obligations and enforce our Terms of Service
We do not use your information for targeted advertising. We do not sell your personal information to third parties.
3. AI Processing and Platform Improvement
The Platform analyzes uploaded media files to generate metadata such as tags, transcripts, and recognition labels using automated processing and artificial intelligence technologies. This processing is performed solely to provide the Platform's features to you.
Vysual may use de-identified and aggregated platform activity data — such as usage patterns, feature adoption rates, and file type distributions — to improve Platform functionality. De-identified data means data that has been processed to remove or obscure all reasonably identifiable personal and organizational information such that re-identification is not reasonably practicable.
Vysual will not use the content of your uploaded assets (video, audio, images, or documents) to train, fine-tune, or develop AI or machine learning models without your separate written consent. This restriction applies to Vysual and to any third-party AI processing vendor acting on Vysual's behalf.
Workspace administrators may disable AI processing features for their Workspace by contacting Vysual support at support@vysual.com.
4. Workspace Collaboration
Workspace administrators may grant access to other users, partners, or collaborators. Users granted access to a Workspace may be able to view, edit, upload, download, or manage assets within that Workspace depending on their assigned permissions.
Vysual does not control relationships between Workspace administrators and their collaborators. Workspace administrators are responsible for managing user access and revoking permissions when a collaborator relationship ends. Vysual is not responsible for the actions of collaborators who are granted access by a Workspace administrator.
5. Sharing of Information
We Do Not Sell Personal Information
Vysual does not sell, rent, or trade personal information to third parties for their own marketing or commercial purposes.
Service Providers and Subprocessors
Vysual shares information with trusted third-party providers that support Platform operations. These providers are contractually obligated to process information only as directed by Vysual and only as necessary to provide services to Vysual. Key subprocessors are listed in Section 6 below.
Legal Requirements
We may disclose information if required to comply with applicable law, a valid court order, a government or regulatory request, or to protect the rights, property, or safety of Vysual, our users, or the public. Where permitted by law, we will attempt to notify affected users before disclosing their information in response to a legal demand.
Business Transfers
If Vysual is involved in a merger, acquisition, financing, or sale of all or a portion of its assets, user information may be transferred as part of that transaction. Vysual will provide affected users with at least thirty (30) days' advance notice via email before such a transfer becomes effective, and will describe any material changes to how their information will be handled. Users who do not wish their data to be transferred may request deletion of their data prior to the transfer effective date.
With Your Consent
We may share your information in other circumstances with your express prior consent.
6. Subprocessors
Vysual uses the following categories of third-party providers to operate the Platform. We maintain contracts with each subprocessor requiring them to implement appropriate security measures and process data only as directed by Vysual.

We will update this table when we add or remove material subprocessors. For changes involving subprocessors that process uploaded asset content, we will provide thirty (30) days' advance notice via email.
7. Data Storage and Retention
Vysual stores digital assets and related metadata associated with your account on servers located in the United States.
We retain your information for as long as your account is active or as necessary to provide the Platform. If you cancel or terminate your account, we will retain your Workspace data for thirty (30) days to allow account restoration or data export. After that period, your stored assets and associated metadata will be permanently and irreversibly deleted from our systems, including backups, within a commercially reasonable time not to exceed ninety (90) days.
You are responsible for maintaining independent backups of important assets stored on the Platform. Vysual is not liable for loss of data resulting from account termination, user error, or circumstances beyond Vysual's reasonable control.
Vysual may retain certain records (such as billing records, correspondence, and security logs) for longer periods as required by applicable law or for legitimate business purposes such as dispute resolution and enforcement of our agreements.
8. Data Security
Vysual uses commercially reasonable technical and organizational security measures to protect your information, including:
- encryption of data in transit using TLS
- encryption of data at rest
- access controls limiting employee access to user data
- regular security reviews and vulnerability assessments
No internet-based system can guarantee absolute security. If you have reason to believe your account has been compromised, please contact us immediately at support@vysual.com.
Data Breach Notification
In the event of a security incident that results in unauthorized access to, disclosure of, or destruction of personal information, Vysual will:
- investigate and contain the incident as promptly as practicable
- notify affected users via email within seventy-two (72) hours of confirming that a breach has occurred, or as soon as reasonably practicable
- notify the Texas Attorney General if the breach affects more than 250 Texas residents, as required by Texas Business & Commerce Code Section 521.053
- cooperate with applicable regulatory authorities and follow all notification requirements under applicable law
Breach notifications will describe the nature of the incident, the categories of information affected, the steps Vysual has taken or is taking in response, and recommended steps you can take to protect yourself.
9. Third-Party Services and Integrations
The Platform may integrate with third-party services. Vysual is not responsible for the privacy practices of those services. Users should review the privacy policies of any third-party services they connect to or use with the Platform. Vysual's subprocessors are listed in Section 6 above.
10. Cookies and Tracking Technologies
The Platform uses cookies and similar technologies to operate and improve your experience. We use the following categories of cookies:
- Strictly Necessary: Required for the Platform to function, including login sessions and security tokens. These cannot be disabled.
- Functional: Remember your preferences and settings, such as display options and workspace configurations.
- Analytics: Help us understand how users interact with the Platform so we can improve it. Data collected is aggregated and de-identified where practicable.
We do not use advertising or tracking cookies for targeted advertising purposes.
You may adjust your browser settings to block or delete cookies. Blocking strictly necessary cookies may impair your ability to use the Platform. A cookie consent banner is displayed to new users upon first access to the Platform, where required by applicable law.
11. Your Privacy Rights
Depending on your location and applicable law, you may have the following rights regarding your personal information:
- Right to Know / Access: Request a copy of the personal information we hold about you.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Delete: Request deletion of your personal information, subject to certain exceptions (such as legal obligations or ongoing business needs).
- Right to Opt Out of Sale or Sharing: We do not sell or share personal information for cross-context behavioral advertising. If this changes, we will update this policy and provide an opt-out mechanism.
- Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.
To submit a request, email us at support@vysual.com with the subject line "Privacy Rights Request" and include your name, account email address, and a description of your request. We will respond within forty-five (45) days. We may request additional information to verify your identity before processing your request.
Texas Data Privacy and Security Act (TDPSA)
If you are a Texas resident, you have the rights described above under the Texas Data Privacy and Security Act (effective July 1, 2024). To exercise your rights, use the contact process described above. If we deny your request, you may appeal by contacting us at support@vysual.com with the subject line "Privacy Rights Appeal." If you are unsatisfied with our response to your appeal, you may contact the Texas Attorney General.
California Residents (CCPA / CPRA)
If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including the right to know the categories of personal information we collect and share, the right to delete, the right to correct, and the right to opt out of the sale or sharing of personal information. To submit a CCPA request, use the contact process described above. We do not sell or share personal information as defined under California law.
Other U.S. State Privacy Laws
Residents of Colorado, Connecticut, Virginia, and other states with comprehensive privacy laws have similar rights to those described above. We honor those rights regardless of your state of residence to the extent required by applicable law.
12. Children's Privacy
The Platform is intended for business use only and is not directed at individuals under the age of 18. Vysual does not knowingly collect personal information from anyone under 18. If we become aware that we have inadvertently collected personal information from a minor, we will delete it promptly. If you believe we have collected information from a minor, please contact us at support@vysual.com.
13. Changes to This Policy
Vysual may update this Privacy Policy from time to time. For material changes — including changes to how we collect, use, or share personal information — we will provide at least thirty (30) days' advance notice via email to the address on file before the changes take effect. For non-material changes, we will update the "Last Updated" date at the top of this policy.
Your continued use of the Platform after the effective date of an updated Privacy Policy constitutes your acceptance of the revised policy. If you do not agree to the changes, you must stop using the Platform and may request deletion of your data before the effective date.
